Welcome to Catermarke. These Terms and Conditions (“Terms”) apply to all online orders, enquiries and interactions made through our website (the “Site”). By using our Site or placing an order, you agree to be bound by these Terms.

1. DEFINITIONS

  • “We”, “Us”, “Our” refer to Catermarke Ltd.
  • “You”, “Your” refers to the customer placing an order or using the Site.
  • “Goods” means catering equipment, products or related items sold by Us.
  • “Contract” means the legally binding agreement between You and Us for the purchase of Goods.

2. ELIGIBILITY TO PURCHASE

To place an order:

  • You must be aged 18 or over;
  • You must provide accurate company or personal information;
  • You must be authorised to make purchases on behalf of your business if applicable.

We primarily supply the restaurant, catering, and hospitality industry, but may also sell to individuals at our discretion.

3. PRODUCT INFORMATION

We make every reasonable effort to ensure product descriptions, specifications, prices and images are accurate.
However:

  • Colours, dimensions, and packaging may vary;
  • Specifications are subject to change by manufacturers;
  • Errors or omissions may occasionally occur.

Where critical, You are responsible for ensuring that Goods meet Your required specifications.

4. PRICES

  • All prices are listed in GBP (£).
  • Prices exclude VAT unless stated otherwise; VAT will be added at checkout.
  • Delivery charges, installation costs or additional services are quoted separately.
  • We reserve the right to change prices without notice before You place an order.

5. ORDERING PROCESS

  1. You submit an order via our website.
  2. You will receive an order acknowledgement email; this does not constitute acceptance.
  3. A Contract is formed only when We send a dispatch confirmation or otherwise confirm acceptance in writing.

We may reject an order if:

  • The Goods are unavailable;
  • There is a pricing or product error;
  • We are unable to obtain payment authorisation;
  • We reasonably suspect fraud.

6. PAYMENT

We accept the payment methods shown at checkout.
Payment must be made in full before dispatch unless otherwise agreed in writing.
We may suspend or cancel orders if payment issues arise.

7. DELIVERY

7.1 Delivery Areas

We deliver across the UK Mainland. Additional charges may apply for Northern Ireland, Scottish Highlands, islands, or international destinations.

7.2 Delivery Times

Estimated delivery times are provided on checkout but are not guaranteed.
Delays may occur due to courier issues, manufacturer delays, or stock availability.

7.3 Delivery Requirements

You must:

  • Provide accurate delivery information;
  • Ensure someone is present to accept delivery;
  • Inspect Goods upon arrival and report transit damage within 24 hours.

Where specialist equipment is ordered, You may need appropriate access, ventilation, or utilities in place.

7.4 Failed or Refused Delivery

If delivery fails due to incorrect information or inaccessibility, re-delivery fees may apply.

8. RISK & OWNERSHIP

  • Risk in the Goods passes to You upon delivery or collection.
  • Ownership remains with Us until full payment is received.

9. RETURNS & CANCELLATIONS

9.1 Business Customers

The Consumer Contracts Regulations do not apply to business-to-business transactions. We do not offer automatic “cooling off” rights to business customers.

Returns are accepted at Our discretion and may be subject to:

  • A restocking fee (typically 20–35% depending on the item);
  • Return carriage costs;
  • Goods being unused and in original packaging.

9.2 Faulty or Damaged Goods

If You receive damaged, defective or incorrect Goods, notify Us within:

  • 24 hours for transit damage;
  • 7 days for other faults.

We may repair, replace or refund at our discretion in accordance with manufacturer warranty terms.

9.3 Goods Excluded from Return

The following cannot be returned unless faulty:

  • Special-order or customised items;
  • Refrigeration or gas equipment that has been installed or used;
  • Consumables (e.g., filters, chemicals, bulbs);
  • Items not returned in resaleable condition.

10. WARRANTIES

Most Goods come with a manufacturer’s warranty.
Warranty terms vary by product type and manufacturer.

Warranties do not cover:

  • Misuse or neglect;
  • Improper installation;
  • Cosmetic damage;
  • Consumables;
  • Damage caused by unauthorised repairs or modifications.

If onsite warranty is offered, it is subject to geographical restrictions and manufacturer approval.

11. LIABILITY

To the maximum extent permitted by law:

  • We are not liable for loss of business, profit, data, or indirect or consequential losses.
  • Our total liability in respect of a Contract will not exceed the value of the Goods purchased.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, or for fraud.

12. INSTALLATION & GAS / ELECTRICAL EQUIPMENT

It is Your responsibility to ensure:

  • Installation is carried out by qualified engineers;
  • Gas appliances are installed by a Gas Safe registered engineer;
  • Electrical equipment is installed by a certified electrician.

Incorrect installation voids warranties.

13. WEBSITE USE

You must not:

  • Misuse the Site;
  • Attempt unauthorised access to servers or systems;
  • Use automated tools to extract data.

We may suspend or terminate access if these rules are breached.

14. INTELLECTUAL PROPERTY

All text, images, graphics, logos and content on the Site are owned by or licensed to Catermarke and protected by copyright and trademark laws.
You may not reproduce or use them without permission.

15. DATA PROTECTION & PRIVACY

Your personal information will be processed in accordance with our Privacy Policy.
We comply with the UK GDPR and Data Protection Act 2018.

16. FORCE MAJEURE

We are not responsible for delays or failure to perform due to events outside our reasonable control, including supplier delays, strikes, natural disasters, pandemics, or transport disruptions.

17. GOVERNING LAW & JURISDICTION

These Terms are governed by English law.
Any disputes will be handled exclusively by the courts of England and Wales.

18. CHANGES TO THESE TERMS

We may update these Terms from time to time. The latest version will always be posted on our Site.
